LE GRAND CLUB RULES
ARTICLE 1 – DEFINITIONS
The objective of Le Grand Club is to ensure access to its members to the different high standing golf courses (“Partner Clubs”) with which a special agreement has been made ensuring that its members benefit from the quality of service equivalent to the one a private golf course would offer its members.
Le Grand Club is a business organisation which belongs exclusively to the company Yusho Ltd which can be transferred to a third party, with obligations to carry on engagements of Yusho Ltd towards the members of the Grand Club.
A Golfing Experience Ltd is the official UK agent of the membership.
The members of Le Grand Club are individual or legal entity who have accepted these club rules and paid their fees for the given year.
ARTICLE 2 – SERVICES RENDERED TO THE MEMBERS OF THE GRAND CLUB
The members of Le Grand Club will benefit from free access to the golf courses and facilities (restaurant, cloakroom,…) of the “Partner Clubs” (list of which you will find in the annexe) on every opened day of the year of each “Partner Clubs” from the 1st March of each year, apart from competition days which require closure of the course.
The access to the “Partner Clubs” will be on a free basis with no green fee to be paid. The free entry can be during the weekend, bank holidays or midweek according to the golf club. The rules of entry will be circulated every year.
The “Partner Clubs” will always be high standing courses. Yusho Ltd has the right to modify the number and the list for the coming year, and will inform its members by letter, two months before the end of the contract. For the given contracted year, the number of “Partner Clubs” cannot be amended, with the exception of failure of one of the “Partner Club”. In this instance, the Grand Club will replace it, whether possible, with another course of equivalent quality within the region.
ARTICLE 3 – STATUS OF MEMBERS
No entry fee will be demanded from the members of the Grand Club.
The member of Le Grand Club will benefit from a contract with a duration of one year, from the 1st March to the 28th February, renewable every year.
The amount of the fee giving access to a membership can be revised every year by Le Grand Club, according to the
market conditions and the number of “Partner Clubs” and each member will be informed of the new fees by letter two months before the end of the contract.
The members of Le Grand Club will have their card reactivated when the next year’s membership fees have been paid.
The members of Le Grand Club commit to respecting each “Partner Clubs” own rules and etiquettes.
The members of Le Grand Club commit to making tee time reservations in the “Partner Clubs” in advance and must have a maximum handicap of 36, with the exception of Moor Park golf course where maximum handicap required is 24 for Men and 30 for Ladies.
The membership is personal and non-transferable, however if the member were to pass away before the end of the contract, the benefit of the membership may be transferred to an heir which will become the member for the contract terms.
ARTICLE 4 – DURATION OF ENGAGEMENT
This agreement is defined for an initial period until the 29th February 2012
After this period, it will be renewed every year, unless termination by one of the party on the 1st February before the expiry of the contract by recorded signed for post.
Since 1993, Le Grand Club has the right to terminate the contract if, on the 1st March of the given year, the number of members is inferior to 100. In this instance, Le Grand Club will reimburse the members without delay of the moneys paid for the given year.
For the first year membership to Le Grand Club, and according to article L 121.16 of the French consumer code which focuses on distance selling, the member of Le Grand Club will benefit from a retraction period of 7 days from signature of the contract, thus being done by recorded signed for post.
This will also apply to members in the UK.
ARTICLE 5 – RESPONSABILITY
The members of Le Grand Club will be covered by the insurance of the owner company of each « Partner Club » when being within the walls of the « Partner Club ».
Within limits of legal & regulations texts, the company Yusho Ltd and A Golfing Experience Ltd will decline responsibility in case of damage caused by one of its members towards other members and in case of loss or theft within the walls of the “Partner Club”.
Each member of Le Grand Club must be insured for damages which he may cause onto a third party or other members and have an official handicap in line with the English Golf Union for the given year.
